Antonio Johnson v. State

ANTONIO W. JOHNSON v. STATE OF MARYLAND
Court of Special Appeals, Kehoe, July 28, 2016,
Double Jeopardy – Manifest Necessity – Where defense counsel presents a detailed, exculpatory narrative in opening and then calls no witness, no abuse of discretion in mistrial

In contrast to cases cured by giving the State latitude in closing, defense presented 26 points in an exculpatory narrative during opening but did not say where the evidence would come from.
No possibility of refuting each point without shifting burden, and can’t disregard in entirety as certain valid points were made.
